Alabama Default Judgement — Proving You Were Not Served

by John Watts on October 27, 2011

What do you do if you have a default judgment against you in Alabama but you were never served with the lawsuit?

You need to consider asking the court to overturn the default judgment by showing to the court that you were never served.

Being served is essential to a court having jurisdiction over you.

So if you can prove you were not served, this may allow the court to set aside the default judgment.

You need to move quickly as you don’t want a judge asking you why you waited for a long time after you found out about the bogus default judgment….
