The statute of limitations is the amount of time that a debt collector has to sue you.
Normally in Alabama it is either 3 years or 6 years.
If the collector has sued you after this time period is over, then that normally is a violation of the Fair Debt Collection Practices Act (FDCPA), allowing you to possibly sue the collector.
Suing you after the statute of limitations has expired also gives you the option to plead this as a defense (“affirmative defense”) and if you are successful you will win the collection case.
